4. Payments and Billing
Unless otherwise specified in a signed agreement, payment for services is due as outlined in the invoice terms. Late payments may incur a service charge or delay in project delivery.
Infogenix reserves the right to suspend or terminate work for accounts that are past due.
All deposits and payments made toward project work are non-refundable once services have begun, as time and resources are allocated immediately upon project initiation.
5. Intellectual Property
Upon full payment, clients retain ownership of final, approved deliverables such as completed website files, graphics, and text content. Infogenix retains ownership of all pre-existing intellectual property, source code libraries, frameworks, and design tools used in the creation of a project.
Infogenix reserves the right to display completed projects and related materials in our portfolio and marketing materials unless otherwise agreed in writing.
6. Client Responsibilities
Clients are responsible for:
- Providing accurate, timely information, content, and feedback necessary for project completion.
- Securing all rights and permissions for materials (e.g., images, text, trademarks) supplied to Infogenix.
- Reviewing and approving deliverables in a timely manner.
Infogenix is not responsible for delays or additional costs resulting from incomplete or inaccurate information provided by the client.
7. Third-Party Services
Our work may include or rely on third-party platforms or tools (e.g., hosting providers, plug-ins, APIs). Infogenix is not responsible for service interruptions, pricing changes, or issues caused by third-party providers. Clients are subject to the terms and conditions of those providers.
8. Limitation of Liability
To the fullest extent permitted by law, Infogenix and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to the use of our Site or Services.
Our total liability for any claim related to our Services will not exceed the total amount paid by the client for those specific Services.
9. Termination
Either party may terminate a project agreement with written notice, according to the terms outlined in the project proposal or contract. Upon termination, the client is responsible for payment of all work completed up to the termination date.
